With the new Workplace Surveillance Act 2005 now beginning to take effect in all NSW workplaces, many employers remain unclear of what needs to be done to make sure their company or organisation complies with its expanded scope.
The new Act has substantially expanded the scope of workplace surveillance by including within its provisions surveillance in workplaces by means of computers and tracking devices. Employers also need to formally notify staff of surveillance processes operating in their workplace – even if surveillance is already being undertaken.
